released after posting a $75,000 bond. authorities are blaming it on a clerical error. paperwork from another defendant's file was accidentally placed in scott's file, leading to his release from jail. the other defendant had a $75,000 bond. >> we have been performing an exhaustive search in the county for frederick scott who is wanted on first degree murder charges. through an unfortunate error he is free right now and we are trying to bring him back in at all costs. >> reporter: his attorney tells news 4 there was another factor involved. one of the two indictments was dropped. the no bond status of the dismissed indictment was not transferred to the case. when he walked out of the jail, he walked out rightfully. he didn't escape. it wasn't a trick. according to online court information, scott was released

november 10th. a bench warrant issued for his arrest friday. cops didn't know about the error until last monday. scott, who is the son of a d.c. police officer, was charged in connection with the shooting death of watson in ed monson. >> we are hoping to get him back in custody right away. if he can turn himself in, it's the best, safest way for anyone involved. we wouldn't want a stand off situation. >> reporter: police are saying they have done everything they can to find this individual, look in the obvious places. they are hoping for the public's help to get him in custody. he's working to try to get him back in custody. i spoke to a relative of the victim in this case. they are aware of this release. at this point, they have no comment on the case. reporting live from palmer park, darcy spencer, back to you. >> thank you. wendy?

police in new york city arrested a man who is a home grown terrorist with plans to attack their town. he was planning to use pipe bombs to attack several locations in new york and target soldiers returning from iraq and afghanistan. they have been tracking him for nearly two years. finally arresting him over the weekend after an nypd informant helped him purchase suppliesupp. he was motivated by his own resentment by the presence of troops in iraq and afghanistan. >> he was using instructions on bomb making from al qaeda's inspire magazine. he had direct tied to a man recently killed in a drone attack. nypd made the arrest. federal authorities declined to get involved because he's mentally unstable.

prosecutors allege oscar ortega fired shots at the white house this month. the defense says there's no witness who can id the shooter. elaine reyes joins us with the latest on this story. >> reporter: he made a first appearance in pennsylvania last week. now he's back in our area to face charges against him. handcuffed with chains around his waist, oscar ortega sat quietly. attempted assassination of the president of the united states. he only responded with a few words when the judge addressed him, replying yes when asked if he understood the charges against him. prosecutors asked for ortega to undergo a forensic exam to determine his competence. the 21-year-old idaho native is accused of traveling to d.c. and firing a semiautomatic rifle at the white house this month. he later crashed his car near the roosevelt bridge and made

his way to pennsylvania where he was caught last week. ortega made this video shortly before his trip to the east coast. >> i am the modern day jesus christ you have been waiting for. >> reporter: his public defender told the judge that the two witnesses in this case couldn't positively identify ortega and their stories conflicted with one another. u.s. prosecutors disagree. oscar ortega has a criminal history in three states, mostly drug and alcohol. he was already on probation. they believe him to be a flight risk. add to that the seriousness of the assassination charges. the judge determined ortega will remain in federal custody. his next hearing is scheduled for next monday. if convicted, he could face life in prison. back to you.

>> elaine reyes, thank you. all right. breaking news tonight. it is official. the so-called supercommittee has given up. the lawmakers on deficit reduction could not reach an agreement on how to cut $1.2 trillion from our nation's deficit. they are split between republicans and democrats and they deadlocked over raising taxes and cutting entitlements. each side spent the day blaming the other. the bipartisan co-chairs released a statement saying they hope congress can build on the panel's work. failure to reach an agreement is going to trigger automatic spending cut that is go into effect january of 2013. lawmakers are trying to find a way around that rule. gloomy. foggy out there. not going to get nicer before thanksgiving, but thanksgiving is looking good. >> doug kammerer is live with the latest. oh, it's murky out there.

>> it really is. a little on the gloomy side this monday. the temperatures have been on the mild side. if you bring temperatures down 10 degrees, then you are talking a nasty day. today, the cloud cover and fog and temperatures average during the afternoon. down to 53 degrees, cooling off a little bit with the wind at 12 miles per hour. current temperatures 47 in martinsburg, 47 in hagerstown and 46 in martins. 63 in freddicsburg. do you think we have a frontal boundary sitting on top of the area? that's the case. that is why we are seeing fog and shower activity. it's on the light side. a drizzle or mist for many of us as we move into the evening hours. you can expect to see it 9:00 and 11:00. the fog is out there. you could see dense fog when you wake up tomorrow morning. more rain on the way.

penn state university tapped a former fbi director to lead the investigation. lieu wi freeh was named to investigate all penn state employees including members of the board of trustees. earlier this month, the grand jury accused jerry sandusky of sexually abusing eight boys over a 15 year period. a few days later, joe paterno was fired for not doing enough when allegations were made. >> this examination will include, among other things, failures and gaps in the

universities control environment, compliant programs and culture which may have enabled the alleged misconduct to a cur, go undetected and not be reported and addressed promptly and properly. >> fre,h headed the fbi between 1993 and 2002. we continue to follow that developing story out of manassas. a tsa agent arrested and charged with sexual assault. it happened on winfield loop. we have live with the latest. >> reporter: police tell us that the victim was being dropped off by a friend when it happened. take a look at the picture of the suspect. it's a 52-year-old. we are told by police that he is a tsa agent. he apparently is a supervisor at dulles international airport. he approaches a woman when she

was walking home sunday morning about 3:30 in the morning. he was wearing his uniform and showed her a badge. at that time, police say the victim was groped and sexually assaulted. the suspect took off on foot. listen to how they caught him so quickly. >> we conduct a canvas of surrounding neighborhoods and residences. during that canvas, a man came out of his residence that matched the description and was immediately interviewed. >> reporter: they hold personnel to the highest professional standards and investigates all levels of misconduct. tsa is working with police on this matter. they are not able to tell us if he posted bail but we are going to continue to follow this story throughout evening and have more on news 4 at 11:00.

the wind picked up by five to ten miles per hour. it's helped the fog situation. we had visibility down to a half mile in some locations. it's coming up a bit. 46 is the temperature in martinsburg. 48 in gaithersburg. this is the area where it's not just gloomy, but cold and gloomy. to the south, a different story. 63 in fredericksburg. better to the south for you folks. here is the visibility. latest is two miles in leesburg. now three in washington. we are above the one mile area. it's good news there. i expect it to go down overnight tonight in some areas. watch as you drive out of town. shower activity is out there. a scattering of green here. most of this very, very light rain. the persistent rain. if you are walking without an umbrella, it feels very, very uncomfortable and enough to get the windshield wipers going. in the panhandle of west virginia. more showers to come.

terrorist. authorities say the 27-year-old was plotting an attack using pipe bombs on soldiers returning to the u.s. he was using articles from al qaeda's inspire magazine to make the bombs. police have been tracking him for nearly two years. mayor gray making changes in his staff. a veteran community worker has been hired as the deputy chief of staff with an eye toward helping the mayor improve his image. stocks took a tumble as the supercommittee in charge of cutting $1.2 trillion appear to be heading toward failure. the dow was down more than 300 points. it recovered to close at 247. the nasdaq s&p down. let's fast 4ward to the weather. doug? >> the temperatures on the warm side to the south of washington.

residents in northern virginia are dealing with power outages this evening. do min yan virginia power reports 10,000 customers are without. 3,000 in alexandria. crews are working on repairs. they are expected to be restored between 8:00 and 10:00. there's no word on what caused the outages at this time. >> a dreary night. thanksgiving the fast approaching. thousands of families are struggling to put food on the table this holiday season. >> we are asking for your help to change that. pat lawson muse is live at the verizon center. she's been out there all day

money for the price of the seat. radioshack and verizon made the naughty list. it's not a thumbs up or thumbs down. it's based on specific policy that is are customer friendly. let's get the latest on the forecast at storm center 4 and doug. >> we are watching how the fog is developing across the region. we saw dense fog about an hour ago, then the wind picks up. now the fog is becoming lighter. now we are seeing the showers move in. you can see the cloud cover. of course, the showers we are going to continue to see here throughout the rest of the evening. what are we talking act as far as temperatures go? the numbers are going to be on the cool side. they are not bad out there at all. we are talking temperatures toward the upper 50s in some locations or upper 40s. as we move through, the rest of the evening hours, more showers overnight through tomorrow. we'll definitely see the showers move through. some of the rain tomorrow, right

around 5:00 could be heavy around the district. your rush hour tomorrow afternoon could be prommatic. we have to talk about that tomorrow. the area of low pressure swings through wednesday. we'll talk more about that. that and the thanksgiving forecast, coming up. >> thank you. we want to go live to the white house. we reported the failure of the supercommittee. let's listen in to the president. >> part of the law required congress to reduce the deficit by an additional $1.2 trillion by the end of this year. in september, i sent them a detailed plan that would have gone above and beyond that goal. it's a plan that would reduce the deficit by $3 trillion, by cutting spending, slowing the growth of medicare/medicaid and asking the wealthiest americans to pay their fair share. in addition, there were a number of other plans to consider from democrats and republicans. all of which promoted a balanced

approach. this kind of balanced approach to reducing our deficit, an approach where everybody gives a little bit and everyone does their fair share. it's supported by an overwhelming majority of americans, democrats, independents and republicans. it's supported by experts and economists from all across the political spectrum. many democrats in congress were willing to put politics aside and commit to reasonable adjustments that would have reduced the cost of medicare as long as it's part of a balanced approach. but, despite the agreement that exists for such an approach, there's too many republicans in congress who have refused to listen to the voices of reason and compromise that are coming from outside of washington. they continue to insist on protecting $100 billion worth of tax cuts for the wealthiest 2% of americans even if it means

reducing education and medical research. even if it means deep cuts in medicare. at this point, at least, they simply will not budge from that negotiating position. so far, that continues to be the main stumbling block that prevented them to further reduce the deficit. now, we are not in the same situation we were in in august. there's no imminent threat to us defaulting on the debt that we owe. there are $1 trillion worth of spending cuts locked in. part of a law i signed this summer stated in congress could not reach an agreement on the deficit, there would be another $1.2 trillion of automatic cuts in 2013, divided equally between domestic spending and defense spending. one way or another, we will trim the deficit by a total of at

least $2.2 trillion over the next ten years. that's going to happen one way or another. we have $1 trillion locked in. either congress comes up with $1.2 trillion or this kicks in and the spending cuts occur that bring an additional 1.2 trillion dallas. the question is whether we can reduce the deficit in a way to help the economy grow, that operates with a skal pal, not a hatch hatchet. if not, whether congress is willing to stick to the painful deal in august for the automatic cuts. some in congress are trying to undo the automatic spending cuts. my message to them is simple. no. i will veto any effort to get rid of those automatic spending cuts domestic and defense spending. there will be no easy off ramps on this one. we need to keep the pressure up

to compromise. not turn off the pressure. the only way these spending cuts will not take place is if congress gets back to work and agrees on a balanced plan to reduce the deficit by at least $1.2 trillion. that's exactly what they need to do. that's the job they promised to do. they still got a year to figure it out. although congress has not come up with an agreement yet, nothing presents them from coming up with an agreement in the days ahead. they can still get a balance ahead. the democrats are prepared to do so. my expectation is some republicans are still interested in preventing the automatic cuts from taking place. as i have from the beginning, i stand willing to work with anybody ready to engage in the effort to create a balanced plan for deficit reduction.

now, in the meantime, we have a lot of work left to do this year. before congress leaves next month, we have to cut taxes for workers and small business owners across america. if we don't act, taxes will go up for every single american starting next year. i'm not about to let that happen. middle class americans can't afford to lose $1,000 next year because congress won't act. i can only hope members of congress fighting so hard to protect tax breaks for the wealthy will fight to protect tax breaks for small business owners. we need to put construction workers on the job building our roads and bridges. we need to put teachers in the classrooms educating our kids. when everybody gets back from thanksgiving, it's time to get work done for the american people. all around the country, americans are working hard to live within their means and meet their responsibilities. i know they expect washington to
